for the Purchase/Utilisation of NSSA’s

Images, Data and Analysis Studies

Definitions

• “NSSA” / “the Agency” means the National Space Science Agency.
• The “user” means the representative of the entity having registered for the purchase/use of data/image within his/her entity and accepted the Terms and Conditions.
• The “entity” means the government/private entity that is requesting to purchase/utilise the data/image.
• “Image”, “data” and “analysis studies” means the products offered by NSSA to be purchased and utilized by the entity/user within the accepted Terms and Conditions.
• “TPM” (Third Party Mission) means a satellite mission operated by any legal body, governmental or non-governmental entity other than NSSA, and for whose data NSSA has been granted a right of distribution to selected users.
• “TPMO” (Third Party Mission Owner) means the operator of the respective TPM. Should data ownership be with a different person or legal entity than the operator of the respective TPM, TPMO shall mean this person or legal entity wherever appropriate.
• “SP” (Service Provider) means any legal body, governmental or non-governmental entity providing analysis, consultancy or any other services other than those provided by TPM and for whose services NSSA has been granted a right of distribution to selected users.
• “TPM data” means information and data, which are originated by the payload of Third Party Mission satellites and owned by the respective TPMO.

General Conditions of Image/Data/Analysis Studies Utilisation

1. By accessing and or using the NSSA website, you are agreeing to be bound by these website Terms and Conditions of Use, all applicable laws and regulations, and that you are responsible for compliance with any applicable local law for the Kingdom of Bahrain. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The user is required to accept these Terms and Conditions before being able to receive images/data/analysis studies.
2. The user is required first to be registered with NSSA by officially submitting his/her information, request and make the required purchase upon acceptance of Terms and Conditions. NSSA will accordingly coordinate with the registered user for the product delivery.

3. The user acknowledges and takes account of scheduling and processing constraints both at satellite and ground segment levels.
4. The user undertakes that the image/data/analysis studies supplied shall not be copied, transferred or otherwise be made available to third parties without the written consent of NSSA.
5. The user shall, at any time, observe the following conditions of use:
   • Use all image/data/analysis studies received exclusively for purposes of the entity’s internal usage.
   • Indemnify NSSA for the full amount of any loss, expense, cost or liability (other than arising from any act, omission or direction of NSSA) resulting from any utilization of image/data/analysis studies, for which NSSA and/or TPMO might be held responsible for any reason whatsoever;
   • Not assign any rights, obligations or interests herein without the prior written approval by NSSA.
6. The user waives any claim against NSSA in the event of any damage directly or indirectly arising from malfunction or interruption in the transmission of data for any reason whatsoever.
7. The user informs NSSA in writing in case of problems with image/data/analysis studies reception or image/data quality.
8. Any publication whatsoever resulting from work carried out using whole or part of NSSA’s image/data/analysis studies or NSSA’s logo or both shall contain the following sentence: “Image/Data/Analysis Studies provided by the National Space Science Agency.” and shall be provided to NSSA for approval.

Restrictions

The User is expressly and emphatically restricted from all of the following:

1. Publishing any Website Material in any media;
2. Selling, sublicensing and/or otherwise commercializing any Website material;
3. Publicly performing and/or showing any Website material;
4. Using this Website in any way that is, or may be, damaging to this Website;
5. Using this Website in any way that impacts user access to this Website;
6. Using this Website contrary to applicable laws and regulations, or in a way that causes, or may cause, harm to the Website, or to any person or business entity;
7. Engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Website, or while using this Website;
8. Using this Website to engage in any advertising or marketing;

Certain areas of this Website are restricted from access by the User and NSSA may further restrict the user to any areas of this Website, at any time, in its sole and absolute discretion. Any user ID and password you may have for this Website are confidential and you must maintain confidentiality of such information.

General Conditions of Image/Data/Analysis Studies Purchase

1. There will be a mandatory application fee that will vary in price depending on the purchasing purpose of the image. This fee shall be paid by the User and is non-refundable.
2. NSSA have the right to cancel the purchase request after a certain period of time from the request approval date if the payment was not successfully completed.
3. Upon successful payment, the user is fully responsible to provide a virus free storage media (e.g. flash, external hard drive) with a suitable capacity on which the purchased images/data/analysis studies will be supplied to the user, at no cost to NSSA. NSSA will then lock the storage media by a unique password that will be sent personally to the user.
4. The product will only be delivered to the registered user, or to a specific receiver based on an official email or letter sent to NSSA from the user highlighting the Name of receiver and his/her National ID number.

Intellectual Property Rights

1. All rights, including copyrights, are owned by or licensed to NSSA, or otherwise used by NSSA as permitted by applicable laws in the Kingdom of Bahrain. The user acknowledges and agrees the full title and ownership, including all derived rights, by NSSA of all purchased/utilised images/data/analysis studies. The user shall acknowledge and agree that copyrights, trademarks, service marks, patents, trade secrets, or other IP rights and laws protect images/data/analysis studies provided. Except as expressly authorized by NSSA in writing, the user shall agree not to sell, re-sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from such images/data/analysis studies.
2. The images, data and analysis studies purchased/utilised are the property of NSSA and are protected by applicable copyright law in the Kingdom of Bahrain.
3. The user clearly marks all NSSA Images/data/analysis studies and analyzed information, irrespective of the form in which it is produced, with NSSA’s logo and as follows: © NSSA (year of reception).
4. In his sphere of influence, the user guarantees respect of NSSA’s intellectual property rights and reports any evidence of unlawful use, including such of third parties, immediately to NSSA in writing.
5. NSSA reserves all copyright, trademark, patent, intellectual and other property rights of the images/data/analysis studies available for purchase. Any unauthorized use, reproduction or printing of the images/data/analysis studies or for any purpose not expressly permitted in these terms of use is strictly prohibited.
6. NSSA’s title and copyright of data shall not prevent recognition of copyright in favor of the entity which may arise as a result of the latter’s own interpretation of NSSA processed data, inputs of data or knowledge from other sources.
7. Systematic retrieval of data or other content from this site to create or compile, directly or indirectly, a collection, compilation, is prohibited. It is also prohibited to:
   1. Use the images/data/analysis studies for any commercial purpose, or for any public display (commercial) without the prior written approval by NSSA;
   2. Remove any copyright or other proprietary notations from the image/data/analysis studies; or
   3. Transfer the image/data/analysis studies to another person or “mirror” the image/data/analysis studies on any other server.

Disclaimer

1. NSSA assumes no responsibility or liability for any errors or omissions in image/data/analysis studies delivered to the user if it was according to the request submitted by the user.
2. NSSA is not responsible and does not guarantee that the image/data/analysis studies delivered is accurate, complete or up-to-date.
3. NSSA provides the agreed amount and/or type of image/data/analysis studies to the user through a virus free storage media provided by the user with a suitable capacity.
4. NSSA, while duly considering the interests of the user, reserves the right to review, modify, suspend or terminate delivery of image/data/analysis studies at any time.
5. The user accepts to modify, suspend or terminate the utilization of NSSA Image/data/analysis studies when so requested by NSSA. The user shall have no right whatsoever to claim for compensation or damage as a consequence of NSSA’s decision to terminate or suspend the delivery of TPM or SP image/data/analysis studies.
6. Neither NSSA, TPMO nor SP guarantee the suitability of image/data/analysis studies and shall not be held liable for any damage derived from the use of such data by the user.
7. NSSA have the right to process raw images/data in accordance with national security measures.
8. NSSA is permitted to revise, update and modify the provided services, prices and application fee at any time as it sees fit, and by using this Website service the user is expected to review the products and prices on a regular basis.
9. NSSA reserves the right to revise, modify/limit access or terminate users accounts at any time it sees fit.

Security

1. For site security purposes and to ensure that this Web service remains available to all users, NSSA uses software programs that monitor network traffic to identify unauthorized attempts to upload or change information. Anyone using the NSSA website expressly consents to such monitoring and is advised that if such monitoring reveals evidence of possible abuse or criminal activity, such evidence may be provided to appropriate law enforcement officials.
2. Unauthorized attempts to upload or change information on NSSA servers are strictly prohibited and may be penalized by applicable laws of the Kingdom of Bahrain.

Privacy Policy

1. Submitting information is strictly voluntary by end users of the NSSA website. By doing so, you are giving NSSA permission to use the information for the intended purpose.
2. Personal Information provided through (i.e. filling forms, sending emails) will be used to respond to your message or request and to produce analytical reports about the services provided by NSSA.
3. NSSA will only retain personal information as long as necessary for the fulfillment of those purposes.
4. NSSA will not disclose personal information to third parties, except when required to do so by law.
5. End users, by sending an email to NSSA should understand that emails are not necessarily secure and therefore not send sensitive or personal information.
6. NSSA will collect and use personal information solely with the objective of fulfilling those purposes specified by us and for other compatible purposes, unless we obtain the consent of the individual concerned or as required by law.
7. Personal data should be relevant to the purposes for which it is to be used, and, to the extent necessary for those purposes, should be accurate, complete, and up-to-date.
8. NSSA uses software to automatically collect and temporarily store certain technical information about end user visit for use in site management and security purposes.

Limitation and Liability

Under no circumstances shall the NSSA be liable or responsible for any direct, indirect, punitive, incidental, special, or consequential damages, claims, proceedings, expanses, losses, injuries or death that result from the use of, or inability to use, the images/data/analysis studies purchased/utilised. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis.

In addition, under no circumstances shall the NSSA be liable for the misuse or unapproved/unsupervised purchases done by the user on behalf of the entity, as the entity shall be solely responsible for its internal processes.

Indemnification

The User hereby indemnifies to the fullest extent the NSSA from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including reasonable attorney’s fees) arising out of or in any way related to the user breach of any of the provisions of these Terms.

Variation of Terms

NSSA is permitted to revise, update and modify these Terms at any time as it sees fit, and by using this Website the user is expected to review such Terms on a regular basis to ensure he/she understand all terms and conditions governing use of this Website.

Governing Law

The NSSA adopted the above image/data/analysis studies usage terms and conditions as per the current applicable Kingdom of Bahrain laws and legislations. Unauthorized use of this image/data/analysis studies may give rise to a claim for damages and/or be a criminal offence as NSSA reserves the full right to take necessary legal action to preserve its information. Any dispute arising out of such use of the image/data/analysis studies is subject to the laws applicable in the Kingdom of Bahrain. Kingdom of Bahrain Courts shall be the competent authority to settle any arising disputes.
